A patent agent is someone who is not admitted to the bar in any state but who has passed the patent bar (registration examination). A patent attorney is simply an attorney who has passed the patent bar. It is an ethical violation for an attorney to hold himself or herself out as a patent attorney without having passed the patent bar exam. |
